Right of Withdrawal, Returns and Warranty

These terms apply to purchases made by consumers in the online store Say Divine.

1. Right of withdrawal

You have the right to withdraw from your purchase within 14 days without giving any reason.

The withdrawal period will expire after 14 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the goods. If goods ordered in one order are delivered separately – from the day on which the last item is received.

To exercise the right of withdrawal, you must inform us (SIA “Labi Meistari”, Lielā iela 6, office 108, Jelgava, LV-3001, Latvia, email: saydivinemail@gmail.com) of your decision to withdraw from the purchase by an unequivocal statement. You can do this:

• online – on the page “Withdraw from Purchase”. If you use this online option, we will send you an acknowledgement of receipt of your withdrawal by email without undue delay, stating its content and the date and time of submission;
• by email or by post. You may use the model withdrawal form below, but it is not obligatory.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning the exercise of the right of withdrawal before the withdrawal period has expired.

2. Effects of withdrawal

If you withdraw from the purchase, we will reimburse all payments received from you, including the costs of delivery (with the exception of supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw. We will carry out the reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise. In any event, you will not incur any fees as a result of the reimbursement.

We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.

You shall send back the goods or hand them over to us at Lielā iela 6, office 108, Jelgava, LV-3001, Latvia, without undue delay and in any event not later than 14 days from the day on which you communicate your withdrawal to us. The deadline is met if you send back the goods before the period of 14 days has expired.

You will have to bear the direct cost of returning the goods.

You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

3. When the right of withdrawal does not apply

The right of withdrawal cannot be exercised if the consumer has unsealed goods which are not suitable for return due to health protection or hygiene reasons. This applies to cosmetics and hair care products (shampoos, conditioners, masks, oils, serums, styling products, etc.) if, after delivery, the cap has been opened or the protective seal, film or other hygiene packaging has been removed.

For other goods (e.g. hair dryers, diffusers, brushes), the right of withdrawal also applies if the packaging has been opened to inspect the item; in this case, the liability for diminished value described in section 2 applies.

Legal guarantee – claims for non-conforming goods

Under the Latvian Consumer Rights Protection Law, the consumer has the right to submit a claim for goods that do not conform to the contract within two years of the delivery date. This right applies regardless of any manufacturer's warranty and cannot be restricted.

If a product is damaged, does not match its description or was delivered incorrectly, email saydivinemail@gmail.com with your order number, a description of the problem and, if possible, photos. Depending on the situation, the consumer may request replacement or repair of the product, a price reduction or a refund in accordance with the law. The costs of returning non-conforming goods are borne by the seller.

Electrical appliances (e.g. hair dryers) may also have a manufacturer's commercial warranty; its terms are included with the product. The commercial warranty does not limit the rights under the legal guarantee.

Dispute resolution

If a dispute cannot be resolved through negotiation, the consumer may contact the Consumer Rights Protection Centre of Latvia (www.ptac.gov.lv), including by submitting an application to the Consumer Dispute Resolution Committee (out-of-court dispute resolution), or bring the matter before a court in accordance with the laws of the Republic of Latvia. In cross-border disputes, the consumer may also contact the European Consumer Centre Latvia.
